Enforcement Has Started
POPIA has been fully in force since 1 July 2021. The grace period is over — and estates hold exactly the kind of personal information the Act was written to protect.
The Regulator Is Active
The Information Regulator has already issued real fines under POPIA — R5 million each against two government departments in 2023 and 2024. Both followed the same path: an enforcement notice that went unanswered. Under POPIA, falling short on its own is not an offence — failing to comply with the Regulator's enforcement notice is (s.103(1)), and that is what opens the door to an administrative fine of up to R10 million (s.109) and, on conviction, imprisonment (s.107). What decides the outcome is whether you can show a programme when the letter arrives.
Biometrics & CCTV Are Under the Microscope
The Information Regulator's proposed Gated Access Code of Conduct (gazetted 30 April 2026 for public comment) sets out minimality, retention, and notice requirements for fingerprint scanners, facial recognition and CCTV systems — not yet in force, but a clear signal of where enforcement is heading. Managing Agents Are Liable Too
Managing agents who process personal information on behalf of client estates are Operators under POPIA s.21 and must have a signed Operator Agreement in place. Without one, both the agent and the estate are exposed.

What does the Snapshot actually tell me?

How is my subscription price decided?
By the number of units in your estate. A 30-home estate pays far less than a 1,000-home one, and your exact monthly price is shown before you pay anything. Estates over 2,000 units are quoted individually.
Why a subscription instead of a once-off assessment?
Because compliance isn't a once-off exercise. Your estate's residents, contractors, CCTV and access-control setup change constantly, and a single point-in-time report goes stale the moment any of that changes. A subscription keeps your assessment free to re-run every 6 months, your policies current, and your task list live — instead of paying again each time you need to prove you're still compliant.
Does this apply to my body corporate or sectional title scheme?
Yes. POPIA applies to all organisations that process personal information — including body corporates, sectional title schemes, HOAs, and gated estates. The questions cover all community scheme types.
We already have a managing agent — doesn't that mean we're compliant?
Not necessarily. Your managing agent is an "operator" under POPIA — they process data on your behalf, but your estate remains the "responsible party." You are still legally accountable for compliance, including having a written agreement in place with your managing agent.
Am I personally liable, or is it just the estate?
The fines POPIA sets out apply to your estate as the "responsible party," not to you as an individual. But someone has to be named accountable for getting it right — that's the Information Officer, a specific role with its own duties under POPIA s.55 (registering with the Information Regulator, handling access requests, overseeing compliance — with deputies designated under s.56). When you sign up for PopiGuard you're set up as your estate's Information Officer by default — usually a trustee — though you can hand the role to someone else at any time from Settings. It's the one part of this that's genuinely personal, which is exactly why having a documented programme behind you matters.
What happens to my answers?
Your answers are used only to calculate your results and generate your report. If you provide your email, we'll send you compliance tips. We will never sell your data or share it with third parties.
